  • Tax return document - need help urgent

    Hi Folks.Need help regarding my spouse I-864.
    She needs to submit her tax return form for the most recent year along with the form. Since, we filed our taxes altogether, she didn't file for her tax return individually for this year. In RFE document that we received, it says provide petitioner/spouse most recent tax return.

    My question is, can we submit our joint tax return form that we filed for this year? Your replies will be appreciated

    Yes. If the two of you filed taxes as Married Filing Jointly, that tax return is her tax return (as well as your tax return).

      Thank You. Do you know what other documents we can attach with our application to make it more stronger? I am talking about my spouse documents.
      Also, in RFE, it says my spouse individual tax return document. married joint tax return will also consider as her individual tax return right? Sorry I am just concerned this is the second rfe that we received

          Thank you. Do you think we should give a written statement as well that me and my wife have filed our taxes jointly on marriage basis?

            You don't need a written statement concerning your tax return, it's self-explanatory. It's even better when you submit a joint tax return than an individual one.

              Thank you. In affidavot of support form taxes section, our joint tax will be my wife individual tax for the current year as well right? I am talking about Section 6 part 9a. The total income will be our joint tax return total income correct?

                It is the total income of the household(you+wife). If you are working legally then you can add that income.

                  If you are talking about the questions that ask about the total income from her tax return Part 6 #19a-c, she must put the exact number from the "total income" line from her tax return for those years. She cannot put a different number.

                    I worked till december and i have my W2 till I work. Do I need to attach my W2 copies as well?

                      If the two of you filed jointly, then that tax return is your tax return as well as her tax return. If you guys filed separately, then the two of you will have separate tax returns. No matter how she filed, she must put the exact number from the "total income" line on her tax returns from those years.

                        If you want to attach anything additional, what you can do is include an offer letter or verification letter from her job with the recent paystubs as well. But since your tax return may also include the W2 you may not need the paystubs.
