Experience with EAD/AP expedite
Hi everyone, I am a June filer and I recently had to go through the process of expediting my EAD because USCIS was taking a good amount of time and my OPT EAD at the time was about to expire. My PD is June 8th, and I had no movement on my cases after my biometric appointment. And after almost two months around end of July they sent a RFIE for income not exceeding 125% of the poverty threshold. This RFIE was completely unexpected and I still dont think I should have received it, but what can you do. I replied to the RFIE right away with more documents and used a joint sponsor. I knew this would change my priority date so I started researching ways to expedite my EAD AP as my OPT EAD was about to expire in mid September. I did a request to expedite over the phone in mid August due to financial hardship to self or company (I was the only wage earner, my USC wife depended on my employer provided health insurance, I was leading a big project for my employer and my absence would harm them - they wrote a letter, etc.). After a few days USCIS asked for evidence and specifically asked for a letter from employer stating that they would terminate me if I dont get the EAD on time; I choose not to get that letter but sent all the other evidence stated earlier and waited. Nothing happened for two weeks. At this time I decided to contact my congressman's office, before calling them I got the authorization form from the congressman's website filled it out, and submitted all the evidence sent to USCIS, etc. and faxed them to the congressman's office. I followed up with a phone call the next day. The congressman's office issued a congressional inquiry couple of days later and asked me to wait as they get an answer from USCIS. Then congressmen's office emailed me around 9/4/17 to say that USCIS confirmed that the case was routed for expedited processing. Finally received my EAD on 9/15.
There has been no update on the 485 since the RFIE response was received. I will give it a few more weeks then do a SR or something. I just wanted to share this with you all in case its helpful for anyone. I would say if you have a legitimate issue and need your EAD to move, follow up with your Congressmen. USCIS will at the very least give you an answer. Good luck to y'all.
