  • Green Card by LIFE act

Does anyone have any information on how this one works. I have a relative who in 2001 who through a lawyer applied for the GC but 15 years later they still have not gotten the card. What paper work do they need to show that they qualify for the LIFE act Green Card?

    Thank you,
    Citi2015

They must be the beneficiary of a petition that was filed by April 30, 2001 (e.g. an I-130 relative petition or I-140 employer petition or labor certification). They need a copy of the receipt of that petition filing as proof. For petitions filed after 1998, they also must prove that they were physically present in the US on December 21, 2000. Who petitioned for your relative and when? What do you mean "15 years later they still have not gotten the card"? That doesn't really make sense.

245(i) grandfathering just exempts them from certain requirements of AOS, but they would still need to otherwise be eligible to file AOS now to take advantage of it.

This is my personal opinion and is not to be construed as legal advice.

I applied for AOS thru the life act, my LPR father filed an I-130 & I got approved back in 1996, I married my wife in 2014 to a LPR, she filed another I-130 for me in April 2016 which was approved in June of the same year, she became a USC in November of 16'. We filed for my AOS Feb of this year. Since I had no proof of inspection/entry we used my I-130 from 96' so I could stay in the country while waiting for AOS. I got emails today saying my Combo card went into production today. I hope to get it soon. Wish you the best in your journey
