I-485 Rejected(Outdate form). Do I need to get a new I-693 for re-submission of I-485

  • I-485 Rejected(Outdate form). Do I need to get a new I-693 for re-submission of I-485

    I got I-485, I-765 and I-130 rejection based on outdated version of I-485 form used. All of the forms and other documents have a long number (probably time stamp) at the base of the documents. The sealed I-693 form is returned back opened. It does not have the long number at the base of the documents. Now. I wonder if
    1. I should send a new I-693 form? It involves the medical practitioner and probably second round of fees?
    2. Only I-485 is on outdated version. I will replace it with the latest version of form. Can I still send back other forms (G-325A, I-765, I-130 and G-1145) with the long number (probably time stamp) printed?
    3. My returned check has printed " U.S. Department of Homeland Security" on it. Should I send the same check with the resubmission?
    4. My documents reached Texas office on May 26, 2017 and reviewed on May 30, 2017. Now the retrogression comes into effect from June 1, 2017. Will the USCIS consider my case from May 26, 2017 OR it will consider from June 2017 and will be in retrogression phase.

    Regarding the I-693 medical. The instructions clearly indicate that you must submit an unopened copy of your medical‚ as yours has been opened it would in my opinion not meet that criteria.

    I would also guess that you have no priority date assigned to your case and that will only be assigned once you have successfully filed your paperwork.

    This is just my opinion based on the information you have given and what how I would treat it if it were my own case.

      Thank you very much SRE for your responses. I will ask the doctors office to seal the same form in an envelope. Do you think that it should be OK. Further information regarding my case- I submitted I-140 under EB1a category on May 4, 2017 and is under consideration. For adjustment of status, my documents reached Texas office on May 26, 2017 and reviewed on May 30, 2017. Now the retrogression comes into effect from June 1, 2017 for EB1a category for India.
      1. Will the USCIS consider my case from May 26, 2017 OR it will consider from June 2017 and will be in retrogression phase till October 2017.
      2. Will the USCIS consider I-765 and I-131 (and send me EAD / AP) even if I-485 is retrogressed.

        Your Doctor should be able to give you another copy of the medical that is sealed. My Drs office just gave me another copy of my medical redone on the latest forms at no charge because they said new forms had been issued (I asked them to verify that had done the Gonorrhea test as some Drs seemed to have not done it and as they never gave me a copy of my medical I couldn't tell‚*they had and said they would redo the forms on the latest version to be safe for me at no charge).

        From what I understand by what you have said‚ you currently have nothing filed with USCIS as they rejected your case altogether. Again I assuming that you have no date assigned to your case as you have no case. When your case is accepted you will receive notifications (I-797 Notice of Action) and the one's for your I-485 & I-130 will show a priority date (which is the date that your case was received by USCIS)

          You should enclose the receipt notice of your I140, since this is not concurrent filing. I also would suspect that your I485 would be rejected since the dates have retrogressed. My reasoning is: Let us say this happened prior to the fee change last yr, will USCIS accept the new application with the old fee? No, since the fees have changed. Similarly, I think USCIS would reject due to retrogression. But you can file it and see what happens. You have got nothing to lose since your fee check will not be cashed if they reject your filing.

            Thank you SRE for your response. For resubmitting the I-485 form, what did you check for (Part 3A)- "Have you ever applied for permanent resident status in the U.S.?" Yes OR No. If yes, what did you give as the final disposition.
