Can I request to expedite the process for scheduling interview because of travel?

    Hi guys! I'm thinking about traveling to my home country and stay for about 2 months, but my uscis status has been case ready for interview since April 24th. It's been 45 days and no update on the interview. I got my EAD/AP card in May. I can't book the flight ticket yet because I don't know if the interview would be when I'm outside the U.S.. It is not a emergency travel, it's just my parents miss me and I miss them too, and this is my last summer break in college, so it is the last chance I can leave the states for long.

    In the USCIS emergency travel criteria:
    x Severe financial loss to company or person;
    x Emergency situations;
    x Humanitarian reasons;
    x Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States;
    x Department of Defense or National Interest Situation (Note: The request must come from an official U.S. Government entity and state that delay will be detrimental to the Government.);
    x USCIS error; or
    ? Compelling interest of USCIS.

    I'm not sure what "compelling interest" could be but my reason for traveling does not fit any other criteria.

    Should I call and try anyway? Or can I tell them not to schedule the interview by the time I come back to the states?

    I don't think its a good idea to interrupt your process for anything that is not an emergency but everyone is different.

    More often than not you get at least one month notice to interview date. So I would either buy a one way ticket home and buy the return journey if and when I get notice of interview date or I would buy an open ticket so I can return on short notice. Your family will be glad to see and spend time with you whether its 2 weeks or 2 months.

      Don't do it.

      Don't travel abroad while you case is ready for an Interview.
      Just be patient.
      Once you have attended your interview you could travel the next day but for now. Don't do it.
      Be patient and wait

          Don't buy a one way ticket

          You are waiting for AOS for a Green Card right? So your *intent* is to become a legal Permanent Resident of the US right? A one way ticket can give the impression that your intent is to leave for good.

            Mhm true. Would it be better if I give uscis a call and explain?

              Am not sure where you are getting this but there is nowhere in the INA where it says "A one way ticket can give the impression that your intent is to leave for good" and as such jeopardize your AOS. People buy one way tickets for all kinds of reasons and for sure leaving the country with a one way ticket has zero bearing on the outcome of someones AOS.

                Whether you go or not is up to you. The advice given above has no basis in law. As long as your AP is approved - what you do with it up to you.

                    If you have AP you can travel if you like. The risk you run, is, if you want to come back on short notice and are unable to, because:
                    - you may not be able to book a flight on short notice (which may be one week)
                    - you may miss your flight
                    - flight delays.

                    It is up to you if you want to make an infopass appointment. It really depends who you get, whether they're helpful or not. I know someone who delayed their interview for another process, who had no issues when they wanted to travel before the interview (This was not for AOS). However, it's a risky situation because you never know how your intentions are interpreted by whomever you talk to. You also maybe want to make an infopass appointment and find out what the delay in the process is. Some places take longer than others, but I think it's worth looking into, regardless.

                    I know what it's like to be homesick. If I were you, I would write a list of risk vs benefit of travel. Only you can decide which way works for you.
