    Adjustment of status denied

    My form i -485 was denied because i received initial evidence to submit affidavit of support for my petitioner/sponsor i submitted only sponsor they said i can not appeal but file form i-290B for motion my question is in part 2 of form i-290B what will i write as a brief/additional evidence i have additional evidence but i dont know what to brief pls help

      I misunderstood that your adjustment application was filed

      If it was not, so what?

      When you file your adjustment application, you will no longer removable

      If ICE moves to remove you, you will be granted adjustment of status as a form of relief from removal

      ICE won't move to remove you, because it is inconsistent with their priorities in light of their limited resources

        I'm sorry if I confused some of you or if I wasn't clear enough. It's definitely because I am also confused by my situation.

        ---JAN 06: Application Submitted (Chicago Office): I-485; I-765; I-130; G-325A; I-864 and G-28
        ---JAN 090: Application Received: Receipt Number but no USCIS Alien Number
        ---FEB 06: Forms I-797C, Notice of Action (Sent JAN 31)
        Rejection Notice I-485 and I-765: "Your application is being returned...The payment amount is incorrect...Submit correctly and fully completed application again to the address below: Chicago Office"
        ISSUE: Few weeks before, my lawyer submitted with success an application with previous -lower- fees. We were definitely in the middle of the transition and it seems like both people sending previous amount and new amount got in trouble...

        ---FEB 07: Application REsubmitted (Chicago Office): I-485; I-765; I-130; G-325A; I-864 and G-28 but corrected amount.
        ---FEB 10: Application Received: Receipt Number but no USCIS Alien Number
        ---MAR 03: Forms I-797C, Notice of Action (Sent FEB 28)
        Rejection Notice I-485 and I-765: "Your application is being returned...The payment amount is incorrect...Submit correctd fully completed application again to the address below: Chicago Office"
        ISSUE: My Lawyer didn't understand but didn't bother calling USCIS customer service either...well she should have. Pure waste of time...

        ---MAR 08: Application REsubmitted (Chicago Office): I-485; I-765; I-130; G-325A; I-864 and G-28 same corrected amount.

        ISSUE: My Lawyer finally decided to call USCIS customer service to finally realize she wasn't aware that now USCIS required separated individual checks for every fee amounts. Her mistake...even if later on she told that a USCIS supervisor told her it should have been fine, they're still accepting common check...so frustrating anyway...

        ISSUE: We still don't know...
        Looking at the copy of the application my lawyer sent me, she definitely checked the box (a) in the I-485, Part 2. Application Type.
        Unfortunately we haven't been able to double check the application ourselves before she sent it last time, so I have to trust her.
        However I also found someone who had a similar experience recently and later on received apologies from USCIS (http://www. ******** ***.com/forums/...485-rejection/)
        Definitely willing to hear anybody's else opinion, but I guess we now just have to Resubmit our application once again, this time without the need of making any improvement.

        I hope it makes more sense to everybody now.
        So according to some of your last comments, it sounds like I am indeed authorized to remain in the US until my application is officially denied.
        However it doesn't seem like it is really pending either, since I'm basically still on the depart line...

          i-130 was accepted. I-485 and i-765 have been rejected for some reason. i-130 does nothing for you but establish that you are related to petitioner. You need to properly file i-485 to adjust your status. i-765 and i-131 can be filed concurrently with i-485. First figure out why it has been rejected and go from there. ALSO FIRE THAT LAWYER. if you can do it your self, find another lawyer but FIRE the one you are using now.

            I can only imagine what a painful experience this may have been for you.

            Please, if it's a line-by-line help you need in filling out your forms, please post it here and we'll help you. I did mine myself. As others have suggested, please FIRE your lawyer.
