Possible to remove 2 year conditions on Green Card from abroad?

    Hello all,

    Next September will mark the second anniversary of my receiving a Green card and the right to permanent residence in the United States. I am still happily married to my wife.

    Last year we both applied to Masters programs in the UK starting this Sept, and have received offers and scholarships. Though challenging, this option represents the best option for us both to pursue further education in our respective fields. There's a couple of problems though:

    1. As i Understand it, it can arouse suspicion for a Green Card holder to leave the USA for more than 6 months at a time. While one trip back during the 12 month period of study would be financially feasible, more than that probably would not. As i have a flight booked to London for mid August (to leave a month to find accommodation for us both etc), my total time outside the US would end up at about 13 months... So even if we came back to visit, there would be at least 1 period of over 6 months.

    2. I have to apply to remove the conditions on my conditional Green Card in the 90 days before its expiration date -- for me this would be in the 90 days before September 8th, 2018. Our courses would not finish until later that same month, however.... Is it allowable to file the form from overseas so long as I am back in the US in time for the associated Bio-metrics appt?

    Please advise! Would I be taking a foolish risk in going ahead with this? What can I do to mitigate this risk? Sensible and knowledgeable advice appreciated

    Jonathan,

    You could have your I-751 submitted while outside the U.S., but you must use a U.S. address as your domicile and mailing address. After your card expires, you will need the I-751 receipt, along with your expired Green Card, to reenter the U.S. But you will have to complete the required Biometrics at an Application Support Center, using the Biometrics appointment form sent to you.

      first things first. apply for reentry permit.

        There are some eligibility issues for a Reentry Permit if a 2-year card expires while abroad.
