Hello,
My EB2 PD is Aug 2009. I filed under Computer and Info Systems Manager job category. I moved to EAD in 2014 and gave up my H1.
Now, my company is closing down. Some management guys are working on starting a new company. They want me to join new company as a key employee. Because of my skillset, I can be hired as a Director level which breaks job category. My lawyer is recommending that I move over using AC21 under the same title, then file a new H1B to manage elevated title (no H1B cap applies here as I am AOS pending).
Is that right? Will I have issues getting a new H1B and move to new title (Director or VP level) when the AOS is for manager level continues on?
