  • Adjustment of status after DACA

Hello friends, I recently got married to my girlfriend of 3 years we are about to start the i485 process and have a few questions.

I currently have valid DACA status that expires in December and am currently working as a sales engineer. I have a PA driver's license and work authorization card. I came from Venezuela in '93 at the age of 6 and have been here continuously on an overstayed visa. I am also am Italian citizen. Now on to the questions

    1. Does my wife still have to file an i30 even though I'm already here?

    2. Does DACA change anything in the application process since they already have so much of my information? Ie. Do i have to do a biometrics appointment over again?

    3. I just need general advice on what i need to do first and in what order.

Thank you for reading and I hope y'all can help!

I have DACA as well and I asked a lawyer about DACA impacting the process and she said it does not. This is a completely different and separate process. Having DACA does not necessarily give you a status. It just allows you to work and gives you somewhat of a protection. I have a biometrics appointment already. Maybe having USCIS have all of your information through your DACA might help but that is debatable.

Ok, was just curious, I wasn't expecting any special treatment because of DACA or anything but at the same time they have 99.99% of the information requested already. But alas, such is the world of government bureaucracy...

          1. So from what I have gathered my suggested course of action is file a concurrent i485 and i30?

          2. On the i485 part 2, it looks like I don't fit in to any of the eligibility options, what should I write under "other"?

I would also fill out the I-765 and I-131 forms. I did and my DACA EAD card is expiring in January of next year.

            For Part 2, I checked "a"

Oh I see, part 2 you checked a because of the concurrent i130 petition. Thank you very much.
