  • i-130 rejected (with whole package) because form was outdated

    Hello,

I have been reading y'all for a while, and now I would need your help!

I AM DESPERATE!! I am in the US on a J-1 visa, and my DS2019 is going to expire on June 30th. I applied for adjustment of status and work permit but my forms got rejected since they were outdated. I think this is unbelievable since their expiration date is at the end of the year. Well, I have 2 questions:
1- I want to re-send my application, but what happens if it is wrong again and/or if they do not get it before June 30th? Would it be illegal to apply after my DS2019 expired?
2- Did I lose all the fees or can I "reuse" them?

    Thank you for the help!

    Ada

Down load the current forms here https://www.uscis.gov/forms. Fill and the current forms and refile. You can reuse the money orders/checks if they are the correct amounts.

First, you remain in J-1 status for 30 days after your program ends. Second, what category are you in? If you are in the Immediate Relative category (spouse, under-21 unmarried child, or parent of US citizen), you don't need to be in status to file (you could have stayed for years beyond the end of your program and file and it would make no difference for the AOS).

The "expiration date" on the forms are for internal use and are irrelevant for the user. What matters is the edition date and what edition dates the USCIS web page for that form says are accepted right now. For some forms, some editions that have "expired" years ago are still accepted; whereas for some forms, editions that have not "expired" are no longer accepted.

I believe that if they reject it they will return the check too and not cash it.

This is my personal opinion and is not to be construed as legal advice.

I understand, thank you. Yes I am spouse of a US citizen.
They returned my cashier checks but they are all stamped, that is why I was not sure..they are the right amount of money.
        Thank you!

I am a spouse of an US citizen, therefore I guess it is ok if my visa expires.
The cashier checks are stamped, that is why I wonder if I can reuse them..
          Thank you!
