  • Problem with i 864

    Hi everyone, I've some disturbing questions; I got married with my wife ( US citizen ) since Jan and I'm just about to start the paper work, I have filled mostly all the forms such a the adjustment of status , employment , advance parole, bio data and allient petition and the I 130A, but I'm having a some issues with the affidavit support. Apparently, my wife income was low so she can't sponsor the affidavit, and a friend ought to help me out. But my friend tax income is filled jointly with his wife , which is where I'm having the exact headache about all these
    My friend gave me all the recent tax document and proof of citizenship n letter of employment as well. But how I'm gonna fill the form I 864 and I 864 A for the member household in the joint tax, since his wife is in the joint tax. More so, do I need the wife to submit all support document as my friend did?like the citizenship proof and employment letter ? And in the recent W2 , how can I know the individual income ? And I think It's not necessary to use my spouse low tax income and do I have to submit a letter backing this up as reason why she ( my wife ) can't sponsor the adult ?? Pls any good advice in details will be so welcome and I will really appreciate Thanks

    your wife is your main sponsor so she has to complete i-864 regardless of whether her income is enough or not. No you dont needs your friends wife to supply documents like he did. You can deduce your friends share of the income by using his w2.

        Your joint sponsor will be filling out his I-864, and he has to sign it and swear the information is correct. It doesn't make sense for you to fill it out for him. His current individual income (Part 6 #2) is the current (right now) salary of his current job. If his income is not enough then his wife's income can be counted, as Person 1 (Part 6 #3-5), and she would then have to complete I-864A, and both of their current individual incomes combine to his current household income (Part 6 #15). If his income is enough, her income does not have to be counted, and she does not complete I-864A, and his current household income would just consist of his own individual income.

          Thanks for the apprehend information, and no, I'm not filling the form for my friend nor his wife, that was a mistake in my previous post. I really appreciate your advice, we've been stuck with the I 864; we thought his wife has to fill the form too cos her income is on the tax but you cleared it out pretty well for me now. God bless
