    Hi, my husband and I got married in May (unplanned) while I was in the country on a visa waiver. We completed all paperwork to adjust my status and I did my biometrics last week. Today I received a yellow envelope requesting for initial evidence. I can either show evidence of:

    - i-94, departure and arrival record, form I-512 or a passport showing admission (we sent my esta because that is really all I have)

    Or

    - evidence that I am the spouse of an active U.S Armed force (I am not)

    Or

    if entered without inspection but seeking to adjust status under section 245(I) I would need to submit:
    - signed supplement A
    - $1000 penalty fee
    - other evidence for being eligible for 245(i)

    Can you please help me out and tel me what you have submitted in similar cases? We submitted everything they asked for when we did the paperwork and I can't think of anything we can send them that we haven't already

    So did you send a copy of your I-94? You can send another copy in case they lost it.

      The i-485 really asks for the I-94. It's easily retrievable online through the Customs and Border protection website (link is kindly provided by the previous poster). You mean to say you didn't include that in? or do you think you're waived the I-94 because your on the VWP?

        I believe you pass through the border and must have I-94, you can get online copy of your I-94 from the custom and border patrol website. Enter your info and print a copy, send it to them.

          Just go to the website, enter your info, print the record and send it in. Simple!
