I'm an H1B holder with an approved EB2-140 which may become current in the next few months. My husband is working overseas for the most part of the year. But he is still holding an H4 status so that he could visit me back in the States every now and then. That being said, I would like to know,
1. Can my husband still apply for I-485 Adjustment of Status in the States if he could be in the U.S. then? Would there be any risks that you can think of if he goes by I-485 instead of a Consular Processing?
2. If he does come to the States to file for his I-485 along with mine, then as an H4 holder, does he need to wait until he receives the AP/EAD combo card before he could leave the States? Does he need to wait until the fingerprint is completed?
3. If it does not seem to be feasible for him to apply for I-485 in the States for any significant concerns, what is the alternative? His current job would require him to travel frequently to the U.S.. If he goes by Consular Processing, will there be a significant period of time that he could not travel to the U.S. at all?
