My Wife is Japanese and I'm American. We submitted the I-130 application back in May05 to Ciudad Juarez, Mexico. My wife and I were living in Mexico until Oct05 and then moved to the US. Since Japanese citizens do not require a Visa to enter the US, my wife entered with a Visa waiver. We still have a relative living at our mailing address in Mexico so we figured we would wait until getting an interview date from Juarez and then going back there to the interview rather than starting from scratch here in the US. Only problem is that we moved almost 7 months ago and are tired of waiting. I have received no documentation whatsoever from Cd. Juarez (not even an acknowledgement of receipt, though I do have a case number assigned which I obtained by calling the service center). At this point I do not know when I can expect to have an interview from Ciudad Juarez. Moreover, my wife has to leave the country every 3 months to get a new VISA waiver and this has become a nuisance. My question, is what should I do now? I have considred the following options, but I don't know if they are feasible/ legal.
1. Submit an I-485 (adjustment of status) here in the US indicating that we submitted the I-130 in Mexico, along with copies of the I-130 submitted and receipt of payment etc. Again--my wife entered here with a VISA waiver (she's Japanese) so she is legally in the US.
2. Begin the whole process from scratch here in the US and submit a new I-130 along with a I-485 (as well as I-765 to get a temp work permit).
The way I see it, the advantage of doing Option #1 rather than #2, is if in some way this would speed up my interview date being that my I-130 was submitted to Ciudad Juarez nearly a year ago. Would this help me? I would of course, also save on paying the $175 fee again.
