we filed G 1145, 130 and - 130A along with 485, 131, 765, 864 along with medical screening. along with separate (2)filing fee checks.

07/19/2017 : my check for I-130 is cashed ($535)

Your I-485 will be rejected because a visa number is not available for your category and priority date. Spouse of a permanent resident is in the F2A category, which currently has a wait for visa numbers of almost 2 years. You cannot proceed to the next step (Adjustment of Status in the US or Consular Processing abroad) until a visa number is about to be available.

The answer to your question in this case is you wait after filing I-130, and not file I-485 until a visa number is available.

I still do not think your application will be taken. Your spouse needs to be a US citizen not a permanent resident. If you are on a work visa, then your other way of getting AOS done is through employment.

You should refile these forms when your immigrant visa becomes available (approx August 2019)

If you fail to maintain your H status until then, you will have to instruct the National Visa Center to switch your I-130 to consular processing, and obtain your immigrant visa abroad

they wanted to resubmit my 485 application with copy of notice of 130 receipt



i got the email & text confirmation about my 130 receipt notice along with number and California Service center . am waiting for hard copy.

can i resubmit along with copy of receipt or do i need to wait until approval??? please suggest

i have the copy of 797 receipt notice which they were asking.
