I-131 travel document filed along with marriage based I-485 package

  • I-131 travel document filed along with marriage based I-485 package

    My husband is having a pending Asylum status now, and we got married earlier this year. We are prepping marriage based I-130/I-485 package to adjust his status, and wanted to also include form I-131 travel document to apply an Advanced Parole Document for him. I wondered if anyone has good suggestions for Part 4 item 1a. that what would be our good humanitarian purpose for the temporary foreign travel. He hasn't seen his mother for 5 years since he submitted his asylum application in the US. We planned on having his mother travel to a third country (i.e. Singapore or France) to meet with us this December to celebrate Xmas and NYE. Would that be a good humanitarian purpose for getting the I-131 approved? Please help.

    Only DACA holders, TPS holders, and those with pending asylum applications need to provide a reason for travel when applying for advanced parole

    While your husband has a pending asylum application, he will instead be applying for advance parole on the basis of his pending adjustment of status application

    Applicants for advance parole in connection to pending application for adjustment of status do not need to provide any reasons or plans for travel on their advance parole application form

    You can leave the answers to those questions blank

      Thanks inadmissible. Also, some attorneys suggested us to not file the I-131 in the package. But wait until we receive his green card. Any thoughts on that?

        Most people are cautious about leaving on AP because you are not guaranteed admission back in the US. 99.9% of the people are able get back in but there is that small chance you will be denied for one reason or another. So basically its lawyers being overly cautious.

          You shouldn't get to Part 4 because the form says non-DACA AP applicants skip from the middle of Part 3 to Part 7.
