  • Family based application (marriage) question.

    Hello,

    We are new to the site, and have a couple of questions:

    1- does someone have a list of the forms we need to complete the application ( we want to make sure we ar not forgetting one)

    2- do we just go to an immigration doctor and complete the checkup and send with the initial packet? I did see that paper asks for an alien number, when is the correct time to get this done?

    3- my husband had applied with his ex-wife(us citizen) before, but they stopped the process as they got divorced. He was assigned an A number, when filling the forms together do we use that same number, or leave in blank because this is a new process? Does he get assigned a new a number?

    Alien number

    I was married and divorce in 2005 same like your husband I applied for AOS but didn't finish the process now that a remarried and applied again didn't put down the Alien number they gave me on my I-130 ( I sent that form in November 2016) . But when they responded to my I-130 they gave the same Alien number they had given me back in 2005.

    So my suggestion is if he has the number is better to put in in the application.
    After six months they approved my I-130 and I sent my I-485, I-765 AND affidavit of support I with same Alien number the gave me in 2005.
    Hope this helps. But if in doubt you can always consult with a lawyer that is what I did.Write all your questions usually they charge around 80 dlls. To hear your case and give you their fee. I did that but decided to do everything by myself because I didn't have the money for a lawyer.

    The forms I used were I-130, I-485, I-765 and affidavit of support I -864 to find the fee for the forms check the USCIS.GOV website

      1 - You will need to file the following forms

      I-485 - Application to Register Permanent Residence or Adjust Status

      Use this form to apply for lawful permanent resident status if you are in the United States.


      I-130 - Petition for Alien Relative

      Use this form if you (the petitioner) are a U.S. citizen, lawful permanent resident, or U.S. national and you need to establish your qualifying relationship with an eligible relative (the beneficiary) who wishes to come to or stay in the United States permanently and apply for the Permanent Resident Card (also called a Green Card).


      I-765 / I-131 - If you want a work permit / travel while your AOS is pending

      Certain aliens aliens who are in the United States may file Form I-765, Application for Employment Authorization, to request employment authorization and an Employment Authorization Document (EAD). Other aliens aliens whose immigration status authorizes them to work in the United States without restrictions may also use Form I-765 to apply to U.S. Citizenship and Immigration Services (USCIS) for an EAD that shows such authorization.


      Use this form to apply for travel documents, parole documents, or arrival/departure records.


      Some of the forms require supplemental information and additional forms. All the information is provided on the page for each form.

      2. Authorized Drs for immigration exam

      Enter your address, city, state, or ZIP code to find a designated civil surgeon near you.


      The exam is valid for one year from the date it is completed‚ some people prefer to wait to complete the medical until they have had their interview scheduled so that it does not expire. You may also get an RFE (request for evidence) if you don't submit it that will instruct you what to do (it may state to bring it to the interview).

      3. Old Alien Registration #.

      I also started the process for AOS many years ago and get divorced before two years and as a result never filed to have the conditions removed as we had divorced by then.

      I included my previously issued Alien registration # on all forms where indicated as well as providing copies of all the documentation (passport pages with I-551 stamp etc... ) as part of the material provided. I did NOT include an I-94 as it had been surrendered when I had my AOS interview with my ex-wife the first time around and made copies of all the pages of my passport that was used to enter the US at that time with cancelled visas etc... (again cancelled as part of the original AOS application).

      I also included a copy of my Social Security card as part of the application process. My original Social Security Card had no restrictions on it and is the same one I hold today. My newly issued 10 year Green Card has the same Alien Registration # on it that I was originally issued with my initial AOS application.

      You should use your previously issued Alien Registration # with your application.

        A. G-325a (copy for wife & husband)two copies
        B. I-130
        C. I-130a
        D. I-485
        E. I-693
        F. I-765
        G. I-864
        H. G-1145
        These are the forms u will need plus the fee written on a check or a money order... stipulating which forms the money is for

          No G-325A for the I-130 (the only edition that is currently accepted).

          No G-325A for the newest edition of the I-485 either (if using old edition of I-485 only the beneficiary needs a G-325A)
