  • Help I-864 for AOS concurrent filing

    My principal Sponsor has a good and more than enough current income for the household, has the pay stubs and a letter from work to prove the income, but on 2016 taxes he didn't make enough, so we are also submitting 2015 and 2015. The thing is that he was married filing jointly for 2015/2014 taxes. Question:
    On I-864. Part 6 19.a "most recent". we have no problem with this amount
    19.b. " 2nd most recent".
    19.c. "3rd most recent"

    Which total income we enter For 2nd and 3rd? the whole amount of the married taxes and send only "his"W2's or do we enter "only" his income from the W2's?

    For that question you must enter the exact number it says in the "total income" line of their tax return for that year, no matter how they filed.

      So we'll enter the whole amount but should I sent copy of the taxes but his W2's only since he is the one sponsoring me and he's divorced now.....??

        Yes, if he's sending tax returns or tax return transcripts for those years, he should send W-2s too. (Usually people sending tax return transcripts don't have to send W-2s, but in case of someone who filed jointly and whose spouse from the return is not acting as a household member for the I-864, they need to send W-2s even if they are sending tax return transcripts.)
