  • Denied application by immigration mistake

    Hello everyone
I scheduled for immigration appointment on February 16, 2017.day before my lawyer faxed over request for reschedule cause wife was sick.tow weeks later we got a letter from usics says that application denied.the reason didn't show for interview
Lawyer email a few requests to reopen the case based on immigration mistake but no respond sent by immigration more than 5 months at some point I had a feeling that the lawyer is kind of lost or not really no what to do
I went to another lawyer for consolation and been told that the only way to reopen the case was to file an appeal within 30days and now the only way is refine the all case again from beginning

Im Looking forward to here any professional advice if to wait for the lawyer to reopen or start the all process again
Or anything else I can do
    File in Houston Texas
    Thanks

I'm sorry that this happened to you. The whole point in hiring a lawyer is so that the process can go smoothly and that your paperwork is done correctly the FIRST time. He seems inexperienced to me. I would press him about trying to fix the issue since you have invested so much money into the firm OR I would request that another lawyer within that firm takes over my case (if there's one available).

This is my own take, not professional advice like you asked:

Get a second opinion about appeals. If you can't file an appeal start over, either with the same attorney at no cost to you, or get a new one.

Personally, if the case is straight forward, I will do it myself and thereby keep better track of the process.
      Not legal advice.

Sorry to hear you going through this, My advice is to start the process again without a Lawyer. The reason is that most lawyers are super busy especially if they have more clients.
Secondly, you can keep track of your case yourself, sign up for all the alerts on USCIS website. The process of waiting for reopening will cost you money and since you didn't reply within 30 days to your case, it is considered close. If you want to go with using a lawyer, do better research on the lawyer.

          This is not legal/pro advice.

Seems to me like your lawyer didn't do what he had to do to reschedule your appointment. He might say he did but it doesn't seem like it... Does it?

At this point your options are to redo with the same lawyer (he/she) shouldn't charge you. I would press him down until he gets it right. ( You gotta be careful with this lawyer though. He already failed once.)

Or what I would do- do it myself

or get a very very good lawyer. New lawyer.

Sorry this happened to you. You will be alright.

          This is not legal advice.
