  • Help With New i-485 Form!

    Hi everyone! I have some questions as it pertains to the new i-485 forms. I'm adjusting through marriage. Ok so there's section (Part 8; General Eligibility and In admissibility Grounds) where there are YES and NO answers.

    Ok so question #15 asks if you have ever been denied a visa to the US. I was denied a tourist visa the first time I applied for one in my home country years ago when I was 22 but when I applied last year April I was granted one.
    So does that count for anything? Should I answer YES or NO?

    Also, #17 asks if you have ever violated the terms and conditions of your non-immigrant status. Since I overstayed my time, does that count as a violation and would it affect my application from being successful?
    Should I answer YES or NO?

    My second question is from Part 5; Information About Current Marriage;
    Are they asking information about me(the beneficiary) or my husband (the petitioner). I'm confused LOL

    Oh and one more thing! Do I have to file the i-485 Supplement A form?

    YES
    YES - overstay has no effect on petition when you an Immediate relative which you are.
    Its your marital history. You are the petitioner on i-485.
    No supplement A is only for people adjusting under 245(i) and you are not.
