  • I30 and I485 concurrent filing checklist..please advice

    Hi,
    I am doing I130 and I485 concurrent filing through my wife. I am H1B right now and My wife is a citizen by birth.I filled all documents and ready with my support documents. Please check my checklist and advice me if any changes to required, thank you.

    CHECKLIST :

    1. Check in the amount of US$535 for I-130

    2. Check in the amount of US$1225 for I-485

    3. Form G1145 E-Notification of application/petition acceptance

    4. I-130 Petition For Alien Relative
    • Copy of US Citizen’s birth certificate
    • Copy of marriage certificate
    • G325A signed by US Citizen
    • G325A signed by beneficiary
    • Passport photo of US Citizen (attached with a paper clip to Form I-130 and signed)
    • Passport photo of beneficiary (attached with a paper clip to Form I-130 and signed)
    • Evidence of Bona fide Marriage
    - Copy of lease documents from 6 months
    - Picture that document relationship and marriage (with wife, step daughter and wife's family, tattoo of my name on wife etc)
    -Copy of health insurance cards (with all our names on it)
    -Copy of AT&T joint bill from last 6 months

    5. I-485 Application To Register Permanent Residence Or Adjust Status
    • Continuation pages for Form I-485
    • Copy of Birth Certificate with English translation
    • Copy of passport page with nonimmigrant visa
    • 2 passport photos of beneficiary (attached with a paper clip to Form I-485 and signed)
    • Form I-693 Report of Medical Examination and Vaccination Record (Completed by a Civil Surgeon sealed in an envelope)
    • G325A signed by beneficiary
    • Copy of I-94 Form (front and back)

    6. I-765 Application For Employment Document
    • 2 passport photos of beneficiary (attached with a paper clip to Form I-765 and signed)
    • Copy of passport page with non immigrant visa

    7. I-864 Affidavit of Support (My wife's income is not sufficient since she started working only from 11/2016 and didn't work in 2014,2015. So, I am adding my income as a beneficiary living together with sponsor from more than 6 months)
    • A letter from wife stating why didn't she file taxes because she didn't work in 2014 and 2015. She has it for 2016.
    • Wife's 2016 1040,1099 and all the pay stubs in 2017
    •My 2016 1099, pay stubs from last 3 months, Employment Verification Letter from Employer stating my Income and length of employment
    • Lease documents with both names as proof of living from more than 6 months

    Hi, I am just here to share my experience for photo attached.

    *I have my name and date of birth written on the back of photo, just in case photos got swiped down to floor or buried beneath multiple paper/files

    * I have photo kept inside of an envelope, on the envelope I wrote "John Doe's photo"

    * I have the envelope stapled to the first page of each form

    For check attached:
    I have check/money order kept inside of an envelope, on the envelope I wrote as:
    1. Check in the amount of US$535 for I-130, check number #1234567
    2. Check in the amount of US$1225 for I-485, check number #7654321

    And stapled the check envelope on the top of the cover letter.

      Thank you. I will write names and dob backside of photos too. I am thinking to keep each document in a envelope with cover letters for each (for i30,i485,i765 etc) and a overall cover letter. Please let me know if there are more changes I need to make regarding any document.

        I quickly looked at your document, I think you need to have I-130a attached with I-130, and G325a may not need it any more, I might not quite sure because I submitted my AOS few months back. There is constantly changes for application, you had better check USCIS website, make sure you have the most updated form, and follow the instruction.

            And remember to make copy of each page you send in, form/document/evidence, during interview they might ask you question from the answers you put into the application form. Review your application form before walk into the interview room, make sure you and your spouse both do so.

                  Check the expiration date on the forms. Its the top right corner. This will save you a lot of time otherwise if you send them in and its rejected because of the expiration time it'll be a month before you find out.
                  Marriage based AOS concurre
                  Feb 2017 - Date received
                  Feb 2017 - RFE received
                  March 2017 - Biometrics completed
                  April 2017 - RFE response received case no longer on hold
                  April 2017 - Case is being scheduled for interview
                  May 2017 - AP/EAD received:
                  March 2018 - AP/EAD forms sent for renewal
                  Sept 2018 - AOS interview scheduled.
                  Oct 2018 - AOS interview
                  Nov 2018 - Green card in hand

                    take a look at the Table of contents put together by Emerald 2020. It's #9. Mine is #3.

                    You want to focus on longevity of your relationship. You want to show that you didn't just meet the day before you got married, and then field a couple of weeks later. If you dated for a while even if just a few months, you want to show text messages, receipts, flight tickets. Evidence of bona fide marriage does not refer to evidence gathered AFTER your marriage. It refers to entering the marriage for love and not to evade the immigration laws of the US.

                      Checked the instructions for I-485, most probably you would need to attached to it copy of your Marriage Certificate as well.

                      Send only a copy of your Marriage Certificate and any other documents in general, they don't return any submitted documents including originals.
