first time posting, hoping to find a little bit of help. I came to the US with a student visa, married my now-husband and consequently applied for an adjustment of status (i-485). After the initial application, we received a request for initial evidence because there was supporting documents for the affidavit of support missing. We sent his most recent paystubs, income return, letter of employment and bank statement. However, we have now received the same request for evidence AGAIN, saying that the next failure to send these documents will result in denial of the application. I tracked the documents online so they definitely received them.....
The only problem I could see is that the tax return was in form of a 1099 (he started as a freelancer - and is now a full time employee for several months) - and because he only got the job in late august of 2016 it does not show a lot of income so clearly the amount is not 125% of the poverty guidelines....do I need to make clear to them that this is the case? I assumed that this would be self-explanatory because the letter of employment clearly stated a sufficient salary which the most recent pay stubs prove. We tackled this without a lawyer to save money but I'm now considering going to one to fix this. Does anyone know what I could have done wrong or has been in the same situation?
