RFE on False Criminal History. Any suggestion?
So I received a notice from USCIC office in Houston in regards to my wife's AOS. It stated...
"Our record shows you have been convicted of a crime in your country" Please submit documents court and police report documents of your case before Oct 21 before we can proceed with your case"
Now. This is the part that gets me. While she was still in Nigeria, One of the documents requested by the American Consulate in Nigeria was for her to submit a police report showing that she has never been in trouble. She submitted the police report. When her visa was approved, I told her to go back and get another police report and bring it with her when coming into the country which she did. We submitted the copy with the I-485 package for her AOS last year which was accepted. Fast forward to last week after doing the Bio Screening and renewing her work permit, the send us that message.
So what I decided to do are as follows...
1. first of all, we filed the G-884 to request the return of the original Police report document . (30 days)
2. We obtained a form from Nigeria that will allow her to do fingerprinting remotely from another country and we just mail the documents to Nigeria. We already did the fingerprinting with the Houston Police Department and we are in the process of sending this to Nigeria as we speak.
Once we get another police report form Nigerian within the next 30 days, We will submit the new police report plus the old one to the USCIS office in Houston. I'm just upset because I feel there a disconnect amongst the USCIS office in Chicago , Houston and consular office. My wife's name can be a common first and last name but still the police report should have been forwarded to the USCIS office from the other locations.
Any other suggestion on what we can do?!?!?
