  • Interview scheduled august 24th- bonafide marriage

    Hello all,
    Need feedback

We got married in October of 2016 since then we have not been living together .
We were thinking of moving together but my company got acquired and due to the uncertainty of my job we didn't moveand eventuall I was laid off in march and end up getting another job on a contract basis till end of august. She lives in Ohio and has a full time job and I live in North Carolina .

Do you guys see this as an issue?

We are having a religious ceremony at the end of the year in india. We will move after coming back from India.

We have joint accounts, Pictures with both families , she is beneficiary on 401k. Health insurance, car insurance. We filed joined taxes together. We see each other every month.

Just be honest and upfront on why you don't live together, and you'll be fine. Just don't lie. Ever. Since you got the joint finances, pictures with both families, you should be fine.

    Good luck!

I do not see an issue. You will be just fine. Don't lie and don't over think things.
Also make sure yours and your wife's reason/explanation for not staying together are matching. No discrepancies.

        K23,

All the other responses in this thread are correct and as long as you have the other evidences you mentioned like joint accounts etc. that is all advantageous.

I had the same situation where I was working in Columbus, Ohio as a consultant while my wife was in Southern Pennsylvania. I worked Mon-Fri in Ohio and drove home to PA every weekend( short drive of only 2 hours - very manageable) and explained to the officer about our living condition truthfully. At the same time, I also informed the Officer that I was working in Ohio, because I was getting paid very well and not finding equally well-paying jobs in PA. Additionally, I was also applying to jobs in OH and PA that seemed to offer opportunity for better pay. I explained that I and my wife were both open to settling down in OH or PA, depending on where I got a better job. I also explained that after trying for a year if I did not get a better offer then I and my wife were gonna settle down in OH. I also took a print out of every job application I had made online to every posting to show that I was attempting to find jobs in PA too. My license showed PA address and all my mail and bills were all coming to our PA address. Officer did not have any doubts and gave us approval within 15 minutes.

The best thing in addition to the documents you have mentioned is to make sure:
        1. Both of you have the same address on your IDs/Driver's license. This shows ample proof that you guys "technically" reside together in some form. Also all your documents should have one mailing address preferably, either NC or OH.

        2. Have as much proof of as possible of all the many times you have driven or flown from NC to OH / OH to NC to visit each other.

        Hope this helps!

          K23,

Had a question. Were you on H1B and lost your job? Did you then convert to EAD as part of Adjustment of status? Or did you join the contract position on H1B and then decided to get married?

Please note that the Officer may ask you about this, in case you were out of status. No need to worry, just make sure you answer truthfully.

          Good Luck!

Thank you SpinSuzuki for your feedback. Our DLs have different addresses. We will make sure to take our flight booking for last year NC/OH or so to the interview.

I was on h1b when we decided to get married. We applied for AOS in January and first week of march I was told that my last day will be march 31st. April 24th is when I started the contracting job. I got my EAD on the same day I started my contracting job.
