  • what is the process to withdraw I-130?

    in June my wife had submitted I-130 for me and from that she is behaving as if she has done some favor on me. i want to withdraw the petition and the application is with California service center.

    Suggestions will be appreciated

    I think you need to explain more. Why would you want to have that withdrawn?
    Forms sent 6/2
    Forms received 6/4
    Received texts/e-mails 6/6
    PD 6/5 & 6/6
    NOA between 6/8 and 6/12 (I was out of town)
    Biometrics letter in mail 6/17 w/ 6/28 date
    SR 9/2
    Contacted Congressman 10/1
    Called the Congressman's office 10/10
    Interview letter 10/10
    Approval Letters for I-765 and I-131 10/16
    Received EAD/AP card 10/17
    Interview 11/8 RFE after
    New Card Being Produced 11/16
    Conditional GC received 11/24

      You can not withdraw her petition. That's up to her

        we cant get along any more on this marriage and so i decided to withdraw it as there wont be any dependency on her

          You don't need to do anything. If you don't file I-485 when your PD becomes current in late 2019, you won't receive any immigration benefits as a result of her petition

          I'm sorry about your marriage

          You're done with this - you have your own H visa to rely on, and you can ignore the I-130 filed by her
