  • HELP! 87 DAY NOTICE! MANY MISTAKES BELOW! FORM I-864, affidavit of support & PASSPORT

    Hi all! First, Thank you for reading this! It's soo hard when you are doing this without an attorney! And we have had a string of bad luck that ugh! Maybe you will be our shining light?! I hope so...

    Mistake #1 -- My mother-in-laws visa expired as we were finally getting the medical packet back from the doctors office so we thought we needed to rush off and send it that day. The photocopy machine wasn't working so I only was able to copy some of the paperwork I sent in. We accidentally sent in the original Birth certificate of my husband. Which has that I am married to him. I have no idea where our originial Marriage Cert is and we got married overseas (where my inlaws and my family are). So this is just to say we thought we were rushed to send in the package.

    Mistake #2 -- In the whirlwind of sending papers and taking them to so many places. We lost HER passport! We have searched everywhere and even sent a form to the USCIS to see if they have it. Hopefully they do, but in the meantime, should we just call the police, file it missing or stolen and show it to the Embassy to get another one??

    Mistake #3 -- We did not know about the form I-864, and that you needed to send it with the I-485 and I-130 and medic package and all the other forms, oh so many forms!! :'(
    Now we have about 67 days because I have been gathering information, Problem is that we do NOT MAKE ENOUGH MONEY $$$. BUT -- we have a lot of property that are ours, debt free and according to the form I-864 we can send that and if it is some percentage, than it counts! COOL! BUT -- My husband, ie sponser, is not in any of the titles. He hadn't gotten the Citizenship yet and we were naive. The real estate agent said it is not necessary to put both names on properties, so we didn't. It is all in my name.

    Question #1 -- I want to send proof that we are married, with the proof of property as well as our taxes, that we file jointly. Will that be considered enough proof?
    Question #2-- Should I wait for the response of the USCIS about the lost passport or go to the Embassy and get another one that has no visa stamped on it or her many travels?

      Sorry to hear that. But have faith. It will eventually work out with your hard work. Has it been 67 days since your PD day? My suggestion is call the USCIS customer number and explain your situation ask for suggestion/answer. They will know better than anyone here.

      Q1. The USCIS will send you an Request for initial evidence if it needed. So wait for that and send whatever they ask for. I does send the taxes paper filed jointly and joint saving account as a support document when filing.
      Q2. Call them to find out.

      An additional way is schedule an info pass appointment with your local office and do service request in person.

      Besides all that, get a good attorney to help if you could afford. At least find one and do a consult. Some lawyer do a free initial consult. Don't save a penny but lost a hundred. I was gonna do it myself but with all the forms and lack of experience. I end up to hired an lawyer to do that because I can't afford of an mistake on this due to travel plan. They helped me filled up my application in two days (in the meanwhile I am collecting every docs that I could) and filed my case the next day. So like I said, a professional help will definitely worth it.

      It's only my pinion tho. Good luck!

        I think you should call USCIS office and explain to them,if they cant do much then you should get a lawyer

            Can't afford lawyer

            I spoke with one as a consult and he gave us glimmering generalities so that he can charge us for doing this. I have already done my husbands: fiance stuff, permanant residency, citizenship and now doing this. All have gone very well. This one is because I lost the damn passport. We already took her to do fingerprinting.

            I sent in a form to ask for all the original documents back and they have yet to send it. I was reading that they sometimes destroy original docs. But i don't know with the passport thing.

              Whether she's in status or not is completely irrelevant for her AOS, so there was no reason why you guys should have been rushing.

              USCIS will not send back something if you sent it to them. They can apply for a new passport on the basis of it being lost. A passport is not technically necessary for AOS, but she will need some kind of ID for biometrics, and having a passport is also good in general (e.g. if they have urgent need to leave once they get their AP).

              You are your husband's household member, and your income and assets can be counted as part of his household income and household assets on his I-864, if you file I-864A.

              You don't need proof that you are married, in the case of an I-864A from a spouse.

              No. Again, USCIS will not return something if you sent it to them, so there is no point in waiting.
