  • Help Adjusting Status With TPS-Haiti

    Good afternoon,

I came to the US in 2004 when I was 7 years old and I never left since. I did not come here on a Visa, and I have no idea how I got here. After the earthquake in 2010 I was able to get the TPS which is now my current immigration status. I got married on 2015 and me and my husband never really focused on adjusting my status since I didn't want him to believe that was the reason we got married. Just recently TPS Haiti has only been extended for six months and can potentially be done for in January. Im filling the forms ill list below, but theres one particular question on the I-485 #71 that states" Have you ever entered the united states without being inspected? I answered yes, which was back in 2004 when I came to the US. Just recently I traveled back to Haiti on advance parole and got an I-94 thats currently valid until January. My question is would the determine the decision factor of my application? or would I need to file form I-601 Application for Waiver of Grounds of Inadmissibility, since at one point I was in the US with no status. I would appreciate anyones feedback, thank you!

    FORMS
    I-130
    I-693
    I-864
    I-130A
    I-485
    I-765
    I-131

Just to clarify, you entered illegally (as in you snuck across the border without being seen) in 2004? If you went through a border crossing and they saw you and let you in, that would be entry with inspection.

To answer your question, no, it would not affect your application. You have no ban to waive.

This is my personal opinion and is not to be construed as legal advice.

Yes, you answer yes to the question and just state that you entered without inspection on a certain date. Nothing needs to be explained.
