September Submissions - Concurrent Application (I-130,I-485, I-131, I-765, I-864)

I was so confused. We can’t understand each other also, he was retired for 3 years now. So we don’t understand what will be on the tax return transcript if we request or print it.
    Althought im considering to call immigration atty. to avoid another mistake. We also think that we will send the same forms that we sent, from his 2016 tax return showing his proof of income and proof that he dont owe IRS anything and write a letter stating that he is not required to send USCIS any tax return because he is already retired.       Ok relax no need for an immigration attorney. what you need to do is go to the USCIS website and read the instructions on I-864. It tells you everything you need to know. In my opinion I would send the whole form again because I personally dont know if its ok to just fill in one page because the signature is important and you obviously change things from the past form so I would thing resend the whole form seriously it doesent take long like 15 min max.
      You dont necessarily need to provide tax transcript but then you need to send in proof that you werent required to fill one. Also send proof of retirement checks that fulfill the poverty guideline. Those details you guys need to know . Did he file or not. If he needs to file and he didnt then he has to file for the past year before you dan send it off. So few things to clear up before you can proceed in my opinion

        Thanks a lot mustang, i appreciate your responce. Both of us are really soo confused. Additional information, He don’t have pention from being retired because he owned his bussiness before but he said he will be starting (just starting, i don’t know when) to receive money from his SSN? We had assets that we sent with the evidences like 2 copies of house ownership, 2 car tittles, $60k worth of appliances for both house and we even include our jades. Man, im really loosing my patience, both of us don’t have any ideas when it comes to taxes specially with the affidavit of support.

            Thank you mustang, sorry for a very late response been out of town. Anyways,since my spouse is not required to sent tax return or tax documentation (he’s Retired) i think i have an idea of what to do. But i need to talk to my spouse first about it. My plan is to fill up a new form I-864 affidavit of support using Acrobat reader, include all the evidence for our assets, the form showing that my spouse did not owe IRS anything for 2016, (another reason why he did not file tax return besides being retired) and showing the proof of income. ALSO i’m thinking of sending a written (type writting) letter made by my spouse,explaining that he is not required to file tax return because of such and such reasons, and also include the proof of income such as his other home being rented by a young guy since we move in to a condo last july, and explain as well the income of the same house for Air B&B rentals. I also wanted to include his SSN BENIFITS as proof of income and proof that he is already retired.
            What do you think guys? I saw online that we can request for a proof for my spouse SSN. i hope itll turn into an accurate responce for my RFE.

              Yes I think its a good plan. Should satisfy everything. Especially make sure you get that mistake on page 4 right

                    • I see some of you guys have email/text notifications. I was wondering how can I get notifications/updates regarding my case. Seems like getting these texts/emails is better than checking the status online.

                          I’m working on ours. Lol, i already have everything that i needed, the thing is, im having hard time to think about what to put in our explanation letter. And my spouse told me that if they we’re asking to send just the page four (4) of our i-864 then i should send only that page because if i will do fill up the whole 12 forms they might get confuse. He told me that he will just sign page 4 at the back since thats all they needed and focus on the tax documentation (retirement, Ssa benefits) and proof of income that we will replace from his tax return since he’s not required to file because he’s already retired. I need to get my self together. My brain is everywhere right now!

                          • We sent our application off on 15th september and 2 weeks ago received a RFE sent off last week now they've received it lets hope it doesn't take too long from this point. Anyone know what happens now after they review it do I get an interview?

                              Your timeline has been reset to the date that USCIS has received the RFE. The usual process is EAD and then interview but some people have gotten the interview and no EAD. It has been less than 2 months for you which means you aren't even in the EAD processing window. I doubt that you will get anything soon but if you do, great! Did you do your biometrics?

                              My PD is 6/5, biometrics 6/28, SR 9/2, Interview notice 10/10, EAD and AP approval letter 10/16, EAD and AP combo card in hand 10/17. So as you see, the process can take 4 months or even longer. Patience.

                              Received texts/e-mails 6/6
                              PD 6/5 & 6/6
                              NOA between 6/8 and 6/12 (I was out of town)

                                Here is my timeline to help you out. It does not appear that my case "reset" to the date that my RFE response was received.

                                August 7th 2017 - I-130, I-485 and I-765 sent to USCIS (Chicago Lockbox)
                                August 8th 2017 - Delivery via Fedex
                                August 14th 2017 - E-notification of receipt of all applications, checks cashed
                                August 21st 2017 - Mail receipt received for all applications (PD of Aug 8th 2017)
                                August 25th 2017 - Biometrics appointment notice received in mail
                                September 5th 2017 - Biometrics completed
                                September 9th 2017 - Request for Initial Evidence received in mail (regarding form I-864 as part of I-485)
                                October 4th 2017 - RFIE documents sent (Lee Summit, MO)
                                October 5th 2017 - Delivered via Fedex
                                October 6th 2017 - RFIE "received" and under review by USCIS (although this wasn't update online until Oct 18th)
                                October 18th 2017 - Case ready to be scheduled for an interview (although this wasn't updated online until Oct 20th)
                                October 23rd 2017 - Put a service request in over the phone for my 765/EAD application (77th day from original PD)
                                November 1st 2017 - New EAD card in production
                                November 2nd 2017 - Interview scheduled for December 12th 2017
