September Submissions - Concurrent Application (I-130,I-485, I-131, I-765, I-864)

    • Spoke to a tier 2 officer today as its been a month since me SR was lodged, he was trying to say to me that my case is within the normal processing times as the website says they are processing 765's up to July 7th, which we all know is inaccurate and he said it wont get assigned to an officer until its outside normal time lol. Trying to explain that the normal time is 75-90 days and I know people personally with the same PD and later that have received theirs didnt do anything. So congressman will contact them in the new year hopefully can get it sped up. So im just going to enjoy the holidays as I know it wont be until at least next year now. everyone merry christmas and happy holidays

          All my paper were at tha National Benefit Center in Lee's Summit, MO. Don't know why there...but the same office was stated on each of the notices of the case received/acceptation..can't remember the number of the form...think it was i-797?

          I did not hear anything about i-130...I believe that's just an accompanying document to your adjustment of status as your spouse is the one filling it in...my online statuses are still the same...case received or "we sent you request for further evidence on Nov 2" for the i-485...the interview was scheduled for the office in Pittsburgh (where I live)

          Seriously...the fact that you don't see anything on your online page doesn't mean anything...I raised online SR and called 2 level officer on the same day and he told me the same thing about the EAD..that's "right now we are processing cases from July 7"..yet I later found out that the approval was already on it's way...

          • EAD Approved! (Even after Request for Initial Evidence!)

            New user throwing in stats now that things are underway.

            9/2/17 - Package received by USCIS
            9/16/17 - Received biometrics letter
            9/22/17 - Biometrics done
            9/29/17 - Request for Initial Evidence for I-485 ("all supporting tax info")
            11/28/17 - Answer for RFE received by Dept. of Homeland Security (sent via priority mail to corresponding non-PO box address)
            12/20/17 - EAD approval letter (received in the mail 12/23)


            We're an American man and Australian lady ("L") in our 20s applying from the New England area.

            We had some issues gathering the necessary tax information. I won't get into that, but I'll just say that this process was not designed to make it easy on American grad students without incomes. But after a nearly 2 month hiatus that was supposed to reset the clock on everything, our saint of a caseworker came through with the gold just in time for xmas! We're ecstatic.

            Regarding the RFE - at the advice of an immigration lawyer friend, we added a personal note at the end of the cover letter:

            Additionally, we understand that the RFE takes us outside of the original ~90-day period during which L's work rights would normally have been expected to come through. In the past year or so, L and I have been diligent in our frugality, closely budgeting our finances – almost entirely funded by student loans and credit – in order to get by. As I approach my last semester of law school at University College, nearly 3 years since my most recent memory of regular income, I anxiously await my reentry to the job market. However, none of my enthusiasm holds a candle to L's, as she seeks not only to be able to contribute to our household income, but to engage firsthand in the American work force she’s observed and admired since her arrival. All that is to say that any and all expedition in this part of our process, though not expected, would mean the world to us. Thank you for your attention. Happy holidays and kind regards,
            Given the lightning fast approval against all odds just a day before Christmas Eve, I'd be surprised if it didn't play at least a small part. Just a consideration for anyone in a similar position.

              Welcome and thanks for sharing .
              Congrats on the approval although I am pretty sure it doesn't have anything to do with the paragraph you included.Most of the time an RFIE for financial information which so many people receive does not reset the clock. But what does happen is they put your file on hold or put it on the bottom and process cases from there which looking at your timeline probably happened. We have kind of the same dates and I got mine last month, no RFIE.

                Hi Everyone!
                I called the USCIS level 2 and they also gave me the same answer about I765, that they are on time.
                I'm trying to do an SR online about the I131 today is my 103rd day, but when I tried it, this message showed:
                Your application or petition is currently within the posted processing times. An inquiry may not be created at this time. Further information about recent processing times can be viewed on the uscis.gov webpage.
                Is this normal?

                • September EAD Submission Timeline

                  Anyone that filed in September received an approval?

                  Hello everyone I too would like to share my timeline
                  Filed I-765, I-485, I-131 along with I-912 due to U Visa
                  From Phoenix, AZ

                  9/1/2017 Case was received by USCIS and filing fee was waived for all forms. Notification was mailed
                  **Sometime in September a notice was supposed to be mailed to me informing me of my biometrics appointment scheduled for 10/25/17
                  Lawyer FAILED to notify me

                  12/1/2017 walked into the Phoneix Office and completed Biometrics
                  12/13/2017 1st Service Request was done online

                  12/27/2017 - Day 117 I have yet to hear from USCIS, status online has not changed since "Received Case" I'm assuming my case is being processed by NBC in Vermont since my receipt number starts with EAC.

                  I haven't called USCIS to ask about my case I just did the SR online.
                  What else should I do?? I feel so lost now and worried
                  My U Visa expired so I have not been working Im a single parent so there is no source of income what so ever, not receiving any type of state benefits
                  Any advice would be highly appreciated

                    Today I recived my Intrview letter ,My PD 11 September ,I recived RFIE on 5 October and RFIE 9 November Recived .Till now I don't hear about EAD any recommendation for intrview .Thanks wish all luck .

                          • Just got mail from USCIS hoping to be my ead/ap approval. bitterly devastating to see it is a RFIE for the i-864!! after 101days!!!!! I mean i wouldnt be so upset if it came in the first 50days like a lot of people but to get it so deep into waiting is devastating. I know technically this restarts the clock however Im hopeful based on what others have said in the forum that this wont be the case. and with it being holidays my wife wont be able to get a letter of employment until jan 8th at the earliest.

                                RFIE does not mean that your PD has been reset...especially when it's for i-864 which is connected to i-495 not to your i-765...it seems they work on the cases separately anyways ;o) so chin up...you never know...it can be anytime now you'll receive your notice of approval for EAD. Have you raised SR?
