    Dear all,

    I am a Pakistani citizen and going to marry a US green card holder. We got engaged one week back. I have completed MBBS from Pakistan and currently doing job in my home country. I have not yet written USMLE. My plan is to give USMLE step 1 in FEB 2018 and Step 2 CK by June and and CS by August 2018. I am confused and I would like to know the options of entering USA because we would like to marry in USA rather than our home country. My fiance wishes to file my application for green card from USA because if we apply from our own country Pakistan, this will take around 3 or 4 years. I need your expert advice regarding adjustment of status. Please note that I know my fiance from last 3 years and we have a record of ********/email/photos etc.



    My questions are:
    If I come to USA on J1 visa and then get married on J1 visa. Will my fiance be able to apply for my adjustment of status? Will the marriage lead to cancellation of J1 visa?
    If I come to USA on student visa, Is it possible to maintain student status while being married to a US green card holder.
    Are there any job opportunities in USA for me? Are there any organizations who can offer me a work visa based on my research experience?

    Yes it's possible. Your fiance will be able to file AOS from any of those Visas. With what is going on in the USA right now your chances of getting a work Visa are very very small - close to none. So I would put that option behind.

    Yes you can be a student and get married. But be careful. If immi digs deeper they gonna know you are coming here for girl not school and you might be denied student visa and that will complicate everything when you apply for other visas

    The best and wisest option is for your fiancee to file K1 fiancee Visa for you to get here and then be married in 90 days of you being here.

      It is illegal to come to US with the intention of adjusting status using a non immigrant visa. If your wife to be becomes an US citizen it might speed up the process for you but it will still take some time.

        First of all, a spouse of a permanent resident is in the F2A category, which has a wait for visa numbers of around 2 years. That means you have to wait that long after the filing of the I-130 petition before you are eligible for either Adjustment of Status (if you are in the US and in status at that time) or Consular Processing (otherwise). You will not be able to do AOS quickly even if you manage to enter the US.

        You are likely to be denied entry on J or F visas if the officer suspects you intend to do AOS on that stay. H or L work visas don't have that issue, if you are able to get one of those visas.

        Also, some J1 have the 2-year home residency requirement, and you want to avoid those because if you come on a J1 with a home residency requirement, it means you cannot immigrate to the US until you have been physically present in your home country for 2 years afterwards.

          1) Probably not, the J visa home residency requirement is designed specifically to ensure folks like you return home. You won't be able to adjust status, but you will get to be closer to your spouse
          2) Probably yes, but you may not be able to travel and return to the United States after marriage. Your immigrant intent will be examined each time you try to enter
          3) Probably. It's on you to get a job, but the good news is that a research institute or non-profit (including most hospitals) can sponsor an H visa for you that is exempt from the H visa lottery
