  • Help About AOS i485 Question !!!

    Hi everybody. I am getting ready to file my AOS soon. I got married July 15th. I need help about the question 17 on Part 8 of i-485
    Here is the question ;

    Have you EVER violated the terms or conditions of your non immigrant status ?
    Yes No

    I came as J1 in 2013 and applied for B2 for 2 times, and overstayed after the B2 expired. I am not sure which one I am suppose to mark for this question.
    If anybody helps this out, I would appreciate. Thank you!

    Overstay = violation. So you need to say yes and provide explanation of what happened, as the form tells you to do so.

      You are married to a US citizen, right?

      Say yes to that question, and simply state when your status ended and that you didn't leave. No further explanation is needed. Your overstay is not relevant for your AOS.
