I've been a long time member and I enjoy reading the stories on everyone's path to residency.
I'm here to share my story and time line.
My husband and I will be married two years this October 2017.We were dating 1.5 years before we married. Hubby is 3 years younger.
Came here as F-1. Got engaged in April 2015,married in October 2015. Fell out of status in September 2015, unintentionally and unaware.( I'm so concerned this will be a red flag at our inter view).
0ct 12th 2016: filed my concurrent I-130 and I-485
Oct 26 2016: file returned due to wrong amount.( they sent my file back twice, I kept adding the wrong total filing fee until November 2nd when I realized we kept forgetting the I-130 amount.. So weird!!
Nove 8th 2016. check cashed and I received my notice of action of approval of the package and RFE for affidavit of support( we didn't realize even if we have a joint sponsor, we needed hubby to file one too as the main sponsor).
Nov 20th: received biometrics letter for Dec 03.
Dec 16/16 EAD card recieved
January 17, 2017: case is ready to be scheduled for an interview
March 1st, we moved and as of March 23rd:case ready to be scheduled for an interview
August 25th: case has been scheduled for an interview for September 26 2017.
So we have a week to go and now I'm a bit nervous.
Hubby moved in with me in September 2015. He is originally from Sacramento .CA and I live in San Jose, .CA. our interview is in San Jose. Hubby got a job in Sacramento with the help of his dad, so he is there during the week, since January this year and he is home on weekends and I visit him on weekends too, we alternate. I have the lease with him on it from our previous address and he is also on the lease for our new address.
I want to be totally honest in my interview and wanted to check if it's relevant that we mention hw is not home all week, now works in sacramento and so we are not together all the time? Is it a red flag? I mean that's our life right now before the interview.
Also, we are a month away from our 2 year anniversary, do you think I'll still get a conditional or a 10 year if approved?
We got filed almost a year after we married ( we had to save) is that a red flag?
I was just fine and excited for this interview until I read someone say the timing between falling out of status and marriage is questionable. Well, I was already engaged and had an appointment for our wedding already set. Should I bring proof of that to help too?
