Have anyone been in a similar situation before? Please help!!
My husband had a pending Asylum case at the time we submitted the petition package for a marriage based green care (I-130, I-I130A, I-485, I-765, I-131, etc.) We submitted the I-130 package in July, and one month later in Aug, we have received a notice from the Asylum office that his case was transferred to an immigration court, with date TBA. Questions: 1) is this decision going to have any bad impact on our I-130 petition? 2) now, do we need to close his Asylum case so that won't be transferred to the court with a confirmed court date? now the court date is TBA ; 3) does this mean the I-485 we submitted within the I-130 package will by denied, and we have to pay another fee for a new I-485 to be approved at immigration court? thanks for your advice!
