My spouse and I are applying for AOS via marriage and had our interview first week of July. The interview went very well in both of our estimations and didn't ask any tough questions. At the end of the interview, IO asked what name my spouse would like on the green card, and then explained that because the birth certificate did not have the parents' names on it that we would need to submit a long form birth certificate that included that info. IO printed and gave the RFE to use on the spot and we submitted it the following week. To date, there has been no change of our case status from "RFE sent" stating that our case is on hold until they receive the evidence.
In August, we called the NSC and spoke to a tier 2 officers who told us, definitively, that the evidence had been received and that there was no further action required from us.
In September, after 60 days had elapsed with no update, we spoke again to a very helpful tier 2 officer at the NSC who said that they couldn't determine whether the information had been received, but that he would raise a service request and that we would be receiving a notice in the mail advising whether or not the evidence had been received within 10-15 days.
Now, more than two weeks after that service request was raised, we still haven't received any update on the case or confirmation that the evidence we submitted has been received. The date specified in the RFE for submitting evidence by is only 2 weeks away and we are concerned that our case will be denied if they haven't received the evidence. After several more calls to the NSC, they won't escalate us to a tier 2 officer anymore and we get wildly different responses each time we call.
Has anyone been in a similar situation to this? We feel that we've done everything we are supposed to in order to supply the evidence, but can't seem to get any help.
