I 485 filed

Hello Friends,

I have filed my I 485, I 765 and I 131 on July 7th, Finger Print is done and no updates on anything. When I filed adjustment if status i was on OPT. Now it has expired.
My question is:

I have to leave US end of November . If i don't get anything by that time, what are my options?

1. Am i eligible on Fiancee visa even if i was living in US and got married in US?
2. Can i still go to my home country and file ?

You do NOT have to leave the US. You can stay in the US because you have a pending I-485 regardless of whether you have status or not. You CANNOT leave the US until you get your Advance Parole or green card approved or you will automatically abandon your Adjustment of Status.

Why do you need to leave the US? You have something urgent you must do in another country?

You can try and expedite your advance parole if you have a good enough reason.

I am working in Kuwait and got admission in USA. I am an Indian Citizen

Would you guys recommend me apply F1 visa from Kuwait or India?

Yes it is urgent. It’s a family matter. I don’t know how I can expedite the process !!! Would anyone know

Two options you have I think .
1. Call the hotline and expedite try to talk to tier 2 officer because tier 1 officer dont have much sway.
2. Make innfopass apointment at your local USCIS office. They can issue AP if its an absolute emergency

Thank You, But can you please tell me how can i get to the tier 2 officer, 1st officer said you just have to wait and i was afraid to ask for tier 2 officer. Also There is not available info pass appointment in PHOENIX, LOS ANGELES...

Well they should transfer you or expedite if you say you have family emergency.
You have to ask to be transferred to Tier 2.
Sometimes you get bad officers just call again and try .

Have you tried walking in? PHX used to allow emergency AP walk-ins. Have you looked at Tucson office? Why are you scared to ask for a tier 2 officer? Basically your choices are you either find a way to expedite your AP or you leave with out and continue the process using consular processing which can take up to 2 years depending on country of origin. Look at emergency AP on the following link.
