  • Confusion about Case Inquiry

    Hi,

I've tried to search for an answer to this question but couldn't find any, so that's why I'm asking it here: about 2 weeks ago I submitted a case inquiry for my i-765 because I haven't received any update on my case since they received my application in June. 4 days later, they sent me a Request for Initial Evidence, but it was for i-485 and they asked for a complete copy of the most recent tax transcript (I sent tax return and W2s for the most recent year but I guessed for some reasons we might not have included all the W2s forms because my husband had several jobs last year, or they could have fallen out of the package somewhere). Today when I check my uscis account, it said that the case inquiry is currently not assigned for processing. They said in the email that I should expect a reply for the case inquiry by Oct 6, which is tomorrow. I'm just wondering if this is normal or not. Is it because I just got the RFE, they wouldn't do anything with my case inquiry? I thought i765 and i485 are not processed by the same office?

    Thank you.

i-765 is based on i-485. So if there are problems on i-485 ( in this case RFE for taxes) then it delays your i-765. USCIS will only issue you a work permit if your i-485 is prima facie approve able.

I submitted all the required documents July 18. There were no RFE. I also did a case inquiry and received an automated response just as you did. It included Oct 25 as the date for response and a sentence that said document has not been assigned for processing. If your submission were still incomplete you would have received information from them. Just not that online case inquiry gives a generic response. I plan to wait 2 weeks then call.

I hope this helps you to understand a bit more.

Yes your RFE caused the delay.
Yes the forms are processed at different offices but they are treated as 1 case. So yes a 485 rfe can affect the aed processing.
