  • Lawyer for i485?

    Hello,

My friend told me that this forum is a great source of knowledge, so let me try.

We are in the process of getting a Green Card for my wife. I130 is already approved, priority date April 2016 - we can use 'filing date' according to current visa bulletin, so this means form i485 and adjustment of status.

Could somebody tell me, how useful it is to have an attorney for that? We didn't break any laws, our marriage is true, we know ourselves since 2012 and have nothing to hide. How useful is having a lawyer to assist here? Is it just having someone to fill i485? How useful is having a lawyer during the interview?

To make things clear, there are few things that immigration may not like in our case:
    - arriving in the USA 06/2015 and getting married 09/2015 (~ 3 months after the arrival). Civil marriage, no wedding, no photos. Reason: her family in Poland, my family also not living here.
    - my wife is still on B2 Visa, and she was spending ~ 11 months out of 12 here in US. She never overstayed, was always flying back to Europe and staying there for 3 weeks, and coming back through POE on the airport.
    - no photos together. I know this sounds extremely stupid, but we're just not the 'photo couple'; we have maybe 5 photos max. We're just not into it, and not having any family here doesn't help with photos as well.

    To balance things, we have:
    - mortgage together
    - previous apartment lease together
    - ******** / email logs for last 5 years, etc
    - we know each other really, really well

Knowing all of this information - should we get a lawyer for i485 / adjustment of status? Any inputs appreciated.

Shouldn't need a lawyer unless you like paying someone thousands of dollars to fill out forms for you.

This is my personal opinion and is not to be construed as legal advice.

No lawyer needed; read the instruction and questions and complete. You are smart, save the millions you would use with a lawyer.
