My congressman contacted USCIS. This was the reply he got the he forwarded to me

'Thank you for your inquiry regarding this constituent’s immigration matter. Our review indicates that this case is within our current processing time. Processing time information can be found on our website on the USCIS Processing Time Information page. Once further action is taken, a notice will be sent to the address of record.

All expedite requests are reviewed on a case-by-case basis. It is the burden of the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. Please provide additional information/documentation regarding the basis for the expedite request. Please also note that a single letter from the applicant, without additional supporting documentation, does not generally meet the criteria for expedited processing.

We hope the information provided is helpful. If we may be of assistance in the future, please let us know.”

I was on the phone to a Tier 2 employee at USCIS yesterday who told me that the waiting period is no longer 90 days - it is now 6 months.

He told me that my expedite request wasn't approved (I sent in my job offer letter) because I have a sponsor that should be supporting me - so I didn't fall under the criteria for expedition.

    • My experience

Hello guys, I'm Italian and in 06/August I got married to an American.
Everyday I come here to know if it's just me that's going crazy. In fact I've never felt as anxious, depressed as now.
But today I want to share my anxious waiting experience in this process.

      I'm applying from Massachusetts.
      Here my timeline:

      - Priority Date: October 18 2017
      - 10/25/2017 - Received letter of USCIS (National Benefits Center - Missouri) Confirmation for the I-130 I-765 & I-485 applications
      - 03/11/2017 - Received I-797C Letter for Biometrics advice notice
      - 11/20/2017 - Biometrics captured at USCIS in Providence
After fingerprints I received an (Request for Initial Evidence) dated on 11/15/2017, They asked me for the form I-130A, my lawyer forgot to send (I can't believe yet)

So, after 2 weeks we sent the form, and since then no letter, no updates in USCIS status...nothing!
      - Yesterday 01/03/2018 We sent a mail to the Congressman's office.

Today is my 77 day after my PD. I know there are people who are waiting for more time in the process than I am. But It's frustrating.
We can't work, we can't drive, we can't nothing...Sometimes I want to go to the airport come back to Europe and give up the whole process.

      Well, good luck guys.

        • EAD Approved

          Hello October fillers,

wanted to share my timeline and experience with you. First, a brief background of me: married to USC in Sep., filed for all the paperwork in Oct. I was on F-1 visa and my OPT expired on 1/5/18. So when my package was sent on 10/23, I knew that it would be a little bit tight for my timeline. Right before Christmas, my employer helped me to reach out to the congressman's office. Company wrote a letter to address the importance of my help lol (well my company recently laid my only team member off, so there is just me now). Congressman's office was extremely efficient and helpful, told me that if I haven't heard anything by 1/5/18, let them know. I indeed didn't get anything from USCIS on 1/5/18 so I emailed congressman's office again. Next thing I know is my EAD was approved on 1/5/18, and approval notice sent on 1/6, delivered on 1/8 (USPS informed delivery a MUST for everyone!).

          10/24 - PD
11/22 - Biometrics appt. But I walked in on 11/17.
12/22 - Reached out to Congressman's office with employer's letter.
1/5 - OPT expired. EAD approved.
1/8 - Approval notice delivered. (I haven't been home to check the mail yet so I don't know if I-131 was approved as well).

Thank you guys for all of your information!

                Hi Evandro,

                Thanks!

I filed from Indianapolis, Indiana. I'm thinking the field office only affects the biometrics schedule, but I honestly feel like it has nothing to do with my approval. I believe it's mainly the congressman's help. 10/15 is probably normal consider it's still within the 90 days and most people are experiencing delays.. If you need your EAD urgently, you think you can seek help from congressman too? Remember to send them some kind of letter/proof along.

                Best of luck!

Sorry Evandro I didn't see that you've already sent an email to congressman for help. So did you include some kinda of letter from future employer, if you have an offer already? Remember that if you don't have something from employer, USCIS wouldn't consider any of your personal reason as strong proof for expedite service, since you have a sponsor to support you.. or try use medical record of your family member to show the need of traveling.

I don't think job offer is enough either. Have them write something else for you! in my case, the HR department wrote in the letter that without me my company will suffer big loss, financially and operationally, etc. (lol)

With that being said, I don't know how to have the process expedited without a job already..

                  Hope that helps!

                  • Day 98

I called today for an update on my EAD. I spoke with a Tier 2 Level agent who informed me that my case is currently with an adjudicator.

I hope this actually means something and I will have a decision soon! Fingers are crossed seriously tight

Well I came home thinking I got the EAD approval notice (congressman's office told me it was approved on 1/5), but I ended up receiving the interview notice for 2/13. This is moving a lot faster than I was expecting! I believe it has a lot to do with me filing from Indianapolis, IN. Not a popular city for immigrants lol.

Hopefully USCIS has began processing all the October applications!
