After following this forum I realize that a lot of you file for Advanced Parole along with your EAD and Adjustment of Status. Our lawyer did not recommend doing this, should we still file for it now? And if so what do you do? Thank you!

Do you need AP or are you just filing because everyone else does? What were your lawyers reasons for discouraging it? if you really need to just file form i-131 and follow the instructions. Be sure to include a copy of your reciept notice from i-485.

You should absolutely apply for it. It is free and there is no downside. You don't need a reason to apply for it. You don't have to use it if you get it but you have the option in case you need to. If something urgent comes up it will be too late to apply for it.

This is my personal opinion and is not to be construed as legal advice.

I just didn't know if we were supposed to. The lawyer didn't mention anything about it either way. The only reason they mentioned it at all was because my husband has TPS and wanted to adjust his status. But then with the 9th district ruling we didn't need the advanced parole.
We aren't planning on needing it. But was wondering if it was something we should have just in case?

So at this point I should go ahead and wait for the receipt of the i130 and i485 and send it in? Thank you!

Maybe in a kind of complicated case like his, leaving the US is risky. But even in that case, it doesn't hurt to apply for it, since it just gives an additional option.

          Yes, with the I-485 receipt.
