Quick Affidavit of Support Federal Tax Question
Howdy ya'll, this is my first time posting but I'm a long time lurker. It's good to be here!
Anyway, I'm filling out all the documents for my wife's AOS (she came on a K-1 visa and we are now married within the 90 days), but I have a quick question about the Affidavit of Support.
I was a full time student for at least part of all three of the previous tax years, which severely limited my income to the point where I was not required to file for income taxes during any of those years. I did, however, file anyway in 2016 in preparation for the visa and greencard process, and with my current job during this tax year, I am above the 125% poverty guidelines, as supported by all my paystubs and a letter from my employer.
In Part 6, there is a section devoted to Federal income tax information, which is where my question is. Item 18a asks "Have you filed a Federal income tax return for each of the three most recent tax years?" to which the answer is no, I only filed in 2016, not in 2014 or 2015.
That's simple enough, but then Item 20 confuses me. It has a checkbox and states "I was not required to file a Federal income tax return as my income was below the IRS required level and I have attached evidence to support this." Does this question only refer to the most recent tax year (2016), or does it apply to any three of the previous years? If it does apply to any of the three, what evidence would be acceptable? I have my W-2 from 2015, but not from 2014, and I also explained in Part 11 under Additional Information my income and tax situation.
