HELPP!! my i485 case has been pending for 2 years and 5months now!!

  • HELPP!! my i485 case has been pending for 2 years and 5months now!!

    Hi everyone,

    please i need advice on what to do.i have been married since jan 2015. my husband is a US citizen. my husband filed for me june of 2015, and our interview was scheduled for August of 2015. a few days to our interview, it was cancelled, and we didn't even know because we didn't check the mail. when we got there, they said my background check was not out that they will reschedule us. We live in Indianapolis.

    From then till now, they didn't..i called and called. they will say the delay is due to workload not related to my case. sept of 2016, they wrote back to me that i was on the interview queue, but still didn't hear anything from them. We reached out again in Jan of this year, they still told us that workload again. i went to their office downtown and i was told they mistakenly sent my file to LA that she will request an expedite on my case to indianapolis so they can schedule me. she also told me that my background has been out that i should have been rescheduled.

    i waited a couple of months and i went back, she said they didn't reply and sent another email to the LA office. i went back again a couple months and she told me it was my background. she said there is nothing anyone can do that all i have to do is wait. i call the USCIS line too and i was told the same thing.
    i then reached out to the constituency rep of my district to help me, but it was the same reply they gave them that its my background thats pending, which i really doubt. Any time i enquire about my case, LA office replies me that my case is still under extensive review and they don't have a timeframe for when it will be complete.

    Everyone keeps telling me that even a lawyer cant help me and i have called 5 LAWYERS TODAY and they all have not worked on my kind of case before.
    What can i do please? i don't know a lawyer that can handle my case, and i don't know what else to do. i have not seen my family in almost 4 years now.
    my husband is a law abiding, tax paying citizen. And i came into the US legally.

      You should have applied for Advance Parole (as well as EAD) for free together with I-485, and you can renew it for free indefinitely as long as I-485 is pending, and it only takes about 4 months to get after applying, so you shouldn't have issues with travel during this time.

        i have contacted the congress person. They forwared me a copy of the reply the USCIS sent them . its the same thing: my background, which i was previously told its been out a long time ago.

          yes, i know, but with the changing law every now and then, i don't want to risk it. initially, i thought i will get rescheduled, but as time went on, i just thought if they are saying they have issues with my background, i had better stay put cos nothing is certain anymore these days.
