  • I485 spouse query impact on Husband status

    Hi,

    I am on EB2 and application is filled by my Employer.
    I also added my wife to the application while applying for I485.

    we have given the Finger print and medical records needed in 2015 November
    our Date might be current in December2017.
    Now,
    They called again my wife for Finger printing. As she was out of country requested for a change of date.
    1) In that letter we requested any time after December 25th. do the honour the reshuling the appointment for a date we asked?
    2) How many times can we postpobe a Finger printing appointment.

    If the date is current,
    is it possible that I can get the greencard and my wife not getting the greencard as I485 finger printing is not done?
    if that is done what will be her status?

    Please help me

    Many ASC's will allow walk-in's (that is, not according to the specified appointment). When she returns to the United States, she should go to the specified ASC with her appointment letter and valid unexpired government-issued identification, and be prepared to wait longer than if she had attended her specified appointment

      1) what will be the status of her?
      that is can there be a case that I am approved Greencard and she is not?

      2) We are having a issue ..... and .... communiting is difficult.
      so if needed can we postpone the appointment again for finger prints ? how many times max we can postpone?

      3) when we send for appointment date, do they give based on the date we gave (or) is it random?

        That is possible. It is also possible that your case will be delayed so that it can be processed together

        You'll know when you get a NOID in the mail! I don't think USCIS itself has a written policy on this, although individual service centers might. For their own operational efficiency they aren't going to indefinitely toll adjustment of status applications that have effectively been abandoned. I think 120 days is a safe estimate

        Your rescheduling request is forwarded by BPU to the ASC in question, where a staff member will schedule the "next available" appointment. I'm not sure BPU will actually convey any requests for particular dates to the ASC, if you write it on the notice you mail in
