  • CPT Student Apply for I485

    Hello everybody!

First time user here I married my husband (USC) back in September and I filed for I485, I130, I765, and I131. I am currently a CPT student, status expires on 1/5/2018. I am thinking about not renewing my CPT for another semester (expensive and time consuming!) and work on EAD when it gets approved.

So my situation is, due to all of these paperwork filing and heavy workload at work, I have not been focusing on school work at all (may potentially be failing my classes!). I was wondering, will USCIS at some point RFE me for CPT transcripts? I don't know if showing F on my transcripts will make them question my CPT eligibility and therefore deny my I485. However, if they don't care about grades at all, school work is the last thing I can think of now..

    Timeline for my cases:
    10/24/17 USCIS received I485, I130, I131, I765
11/06/17 received mail notice (online status hasn't been posted)
11/10/17 received biometrics appointment notice for 11/22/17

    Thank you for any feedback!

    Regina

Your status is not relevant. All that matters is that you entered the US legally.

This is my personal opinion and is not to be construed as legal advice.

      Hello newacct,

Thanks for replying! I'm a little confused about 'status is not relevant'. I thought USCIS wanted to make sure you not only entered the US legally, but also maintained legal status and worked legally during your entire stay, correct?? With my situation, I am currently working under CPT. That's why I was wondering if I need to maintain my grades to be considered as 'working with valid CPT'??

      Thanks again

      Regina
