  • Applying for adjustment of status - What is your current status?

    Hey guys,

    I thought to create this thread with the goal of understanding other people's position and see how they are solving their problems. Partially to guide me and hopefully others. If you do not mind, share, and if you don't feel comfortable sharing that is ok.

    I applied for adjustment of status after I married my wife (U.S citizen). I am in school getting a Master's to maintain student status (F-1) while my application is ongoing. I was advised by a lawyer that if you fill for adjustment of status and your current status expires during the application, you have higher risks of being removed in the process. My application has been received and its waiting on biometrics now. I am hoping to receive my EAD soon so I can start working and pay for school's next semester.

    So, what is your current status? What stage is your application at? When do you hope for your adjustment of status to be completed?

    Oct 25th - Package Delivered
    Nov 3rd - Checks Cashed
    Nov 5th - Received text and emails for all three cases
    Nov 10th - Receive Letters (Priority Date October 26th)
    Nov 16th - Received Biometrics Appointment
    Nov 29th - Biometrics completed (No case tracker updates)
    Feb 12th - service request
    Mar 25th - Still working on tour case nothing to be updated message
    Apr 11th - RFE letter
    Apr 25th - RFE delivered to USCIS
    May 24th - EAD acceptance email
    June 1st - EAD delivered

    It is very unlikely you would be deported mid-process because you lose your status. You are a very low priority for ICE unless you have a criminal record. You will get your EAD roughly four months after filing and green card is mostly based on how busy your local office is.

      I get the probability is low. However, for me is not worth taking it. I am just wanting to know other people's scenarios

        It's not "probability is low". You are not going to be deported for being out of status with a pending Adjustment of Status if you are eligible for the Adjustment of Status, period. In the highly unlikely chance someone makes a mistake and puts you in removal proceedings in immigration court, and they are not willing to dismiss it, you can simply adjust status through the immigration court. Of course you might still be deported if there is a basis to deport you for reasons other than being out of status, but if there is such a basis to deport you, you would be deported even if you are in status.
