Wrong Date of Birth in I-485 notice of action

  • Wrong Date of Birth in I-485 notice of action

    Hello people!

    I've been reading this forum from day 1 of my application and it's been the greatest help. I need your help one more time to see if something like that has happened to you or you might know something I can do about it.

    I filed the form I-485 for Adjustment of Status on 06/15/2017(Miami,FL). I received a notice of action on June 19, 2017 and I found that my Date of Birth is wrong written.

    I went to the Social Security Administration to apply for a Social Security number on 2 October 2017. They couldn’t assign me with one as the system said my Date of Birth was different than the one on my passport and work permit and they send a mismatch email to USCIS office. They told me I have to wait up to 4 weeks. The day after, 3 October 2017 I made an appointment with USCIS and when I told them the problem they took copies of my passport, ID, work permit and they said it was going to get fixed in 15 to 20 days.

    On 9 November 2017 I received a job offer and I went to the social security administration to see what is happening with my application as I cannot work without one even if I have the work permit. They told me nothing has changed on their system and they send the mismatch to USCIS this time by post. Next day I went to the USCIS office to see what is going on and I talked to a supervisor that told me not only that it is my fault but she treated me like I committed fraud because of one small mistake in one part of one form. She told me nothing could happen and I have to wait until my interview for the Green Card which will be the only time anyone at the USCIS office –with authority – will actually see my file again. This interview could be no earlier than March 2018 because I filled on 15 June 2017 and even though my case is ready to be scheduled for an Interview, they notify you three months beforehand and I haven’t received that notice. The supervisor told me to call the USCIS office to see if they can expedite the interview due to the problem. I called them a minute later only to hear that this cannot happen for anyone and they don’t have the authority. So now I have a job offer from a great company and even though I have my work permit I cannot legally work without the social security.

    Any suggestions? As you understand I am very sad

    Do you have anyone who you can trust in your country to maybe get this fixed? In terms of the process, I would strongly contact your Congress person. Google it and based on your zip code you'll find the person who represents you. Go to him/her, explain your situation and see what they can do. I don't think Social Security Administration can help you in this case.

    My guess is that you have to take this straight to the vital records place in your country.

      you have a work permit so you can legally work. Request an ITIN from IRS and use that for work until you sort out your birthday with SS administration and USCIS.

        (never heard of ITIN before) The thing is that the company has to do a background check before hiring me and there is a required field that needs the SSN. I don't think the ITIN is going to work. Do you?

          So you got your DOB wrong on your application? you weren't clear exactly where they got the wrong DOB from.

            ITIN is used for tax purposes and not for work.

              People use ITIN for work all the time.

              On form be honest. SSN - unavailable.

                People use ITIN as a contracting company (you would be sole proprietor) but not for an individual employee of a company

                  A lot of people that dont qualify for ssn and are working illegally use itin in place of ssn even people who for various reasons who can not get SSN but have legal right to work use ITIN in place of SSN. The OP on the other hand has permission to work albeit with some paper work snafus. So they can wait to straighten it out at interview as told by USCIS or get an ITIN and use that in place of SSN until they get their birth date correct so as to get a SSN.
