  • Tricky Situation, I-864

    Hello,

I am a petitioner working on applying for a Green Card for my wife to become a permanent resident here in the USA. She came here with her F1, so an adjustment of status is going to be done. We have a lawyer involved to aid in getting all the paper work done. When working on the I-864, I barely reach the poverty guidelines. Here in the states, my wife has family that could co-sponsor us for that section of the documentation.

Tricky situation: The problem here is, when my wife applied for her visa she claimed to not have any family here in the USA. If they (her aunt) signs to become a co-sponsor in supporting us, would can problems arise such as deportation. I have not brought this story up to my lawyer, should he know to provide better input or should I find some other way to increase my income.

    Thank you

Isn't necessary to mention what kind of relationship you have with the sponsor the sponsor can be anyone relatives or strangers

But must be a USC or a green card holder

So if her family signs to help co sponsor her and provide all the necessary tax forms, they do not necessary need to define their relationship to us?

Even though she stated she did not have family here. If her aunt here signs to be a co sponsor, the aunt doesn't necessarily need to state who she is when she gives her tax information and further documention? We are worried about this part the most. No conflicts would happen down the line?

Not at all i864 it's all about the beneficiary will not be in a public charge when they receive the green card so make sure the sponsor make enough income to sponsor the beneficiary

A joint sponsor can be anyone who is a US citizen or permanent resident and who is domiciled in the US. They do not need to have any relationship to you.

This is my personal opinion and is not to be construed as legal advice.
