  • i130 , i130a Multiple Questions

    Hello All,

I am in the process of completing forms i130 and i130a for my spouse.

He is currently in USA on a valid H1 Visa and we have been living together since March 2017.

Below are the questions I have:-

    General

    1. I am filling the forms on a computer. Instructions say to mark questions not applicable as N/A but / is not allowed when using a computer. Do I manually write N/A using a black pen after taking a print out in black fields.

    Questions for i130

    1. Page 5. Questions 13a-13f. Do I need to enter his address from his home country (same as the one on his passport)here. He has been in USA since July 2015, but his parents are still in India at the address on his passport.

    2. Page 5 , Question 14. When I enter his USA cell phone number Adobe gives me an error about invalid details. Can this be ignored.

    3. Page 6. Question 16. Email address, also gives same error as 2 above. Can this error be ignored as well.

    4. Page 8, Question 59a - 60b. Do I need to enter our current address here. As mentioned above, we have been living together since March 2017.

    5. Page 8, Question 61a - We will be submitting i485 along with i130 and i130a. Do I enter our current city here, or Chicago?

    Questions i130-a

    1. Page 3. Part 3. He is on H1 visa, and is employed by an Indian firm. Do we need to mention those details here.It is already reflected in Page 2, part 2 employment history.

    Thanks.

1.disable javascript on the pdf file and you should have no problem. Alternatively you can hand write it in after printing.

Since he's doing AOS, his address is in the one in the US.

enter the location of the USCIS field office that covers your address

it asks for the last occupation *outside* the US, not in the US

This is my personal opinion and is not to be construed as legal advice.

So we enter SAME here? because address in US is same as mentioned in question 11 on same page. They specifically ask for address outside of US.

Occupation in the US and outside the US is same. He has been with the same company for last 9 years. It's the same company which has sponsored his H1 visa. The company is based out of Asia. In short it will be same as one mentioned on Page 2 (aka current employer).

Sorry, I was looking at the wrong question. The current address (question 11) is the US address, question 12 is "same", and for question 13 he can put his foreign address, although I am not sure whether it's even necessary to put it at all if he doesn't live there.
