  • New form I-485** NEW QUESTIONS.

    Hi everyone! I'm new to this forum so I don't know if someone already asked this.

    The new form I-485 now asks a lot of more questions than the previous one. How are you guys handling this? Specially with the work question. Part 8, question 16.
    Are you guys having any problems when answering yes?
    Please share your experiences!

    You either worked illegally or not; it shouldn't be a hard question. Whether having worked illegally makes you ineligible for AOS or it doesn't matter is specified in law based on your category. It is not a discretionary matter. For the Immediate Relative category (spouse, unmarried under-21 child, or parent of US citizen), it has no relevance. For employment-based categories, it is not relevant as long as you haven't been out of status or worked illegally for 180 days since the most recent entry. For all other categories, it makes you ineligible for AOS (with certain rare exceptions like 245(i), VAWA, etc.).

      Thank you. The part about "working illegaly" or not I understood, it is not a had question at all. I just wanted to see how immigration is dealing with the answers, since they were not asking this question before.
