Should I write my A-number from OPT on I-485 form?

  • Should I write my A-number from OPT on I-485 form?

    So I have an expired EAD card from OPT, and I am back on F-1 now. Should I write down my A-number from the EAD card on I-485 form? or should I leave it blank? I searched online, but everyone seems to have different opinion about it, and I-485 instruction from USCIS does not clarify this either.

    Does anyone have a definite answer?

    Would I get an RFE or letter of rejection if put my previous A-number on every forms?

    My cousin put her old A-number from her expired EAD-OPT on her AOS forms. She thought her EAD's A-number is permanent, like SSN, so she filled it in. She didn't get a rejection notice, but when her NOA came, USCIS assigned a new A-number, which is what's on her GC now.

      As long as I don't get an RFE or a rejection notice, that's good! Thank you very much. Do you, by any chance, know if your cousin included her old I-20 with the OPT record on it along with the recent I-20? Some people say that I need to include this, but I didn't find any instruction requesting my old I-20 anywhere.

        I suggest you to read the instructions for every form you filled. I am pretty sure copies of all legal immigration documents should be included for I-765. I don't remember on top of my head right now if I-20s are needed for I-485 but searching instructions to find answers to these questions is always a good way to go.

        11/14/2017, I-765 status was changed to "New card is being produced".
        11/16/2017, I-765 status was changed to "Card was Mailed To Me".
        11/18/2017, Approval notices were received in mail for I-765 and 1-131. they would be valid for one year.
        11/20/2017, Combo card was delivered.
        09/06/2018, EAD renewal was received.
        09/17/2018, Fingerprint Review was completed.
        11/19/2018, Interview was scheduled.

          It depends on what basis you are filing your I485. I am guessing it is on the basis of marriage to US citizen spouse. If that indeed is the case, you do not need to include your past I20 information, etc. The past I20 information is to confirm that you have maintained a legal status through out your stay in the US, which would be necessary for example if you were filing I485 on the basis of an approved employment based petition. Spouses of US citizens need not have maintained a legal status, they merely need to have entered with inspection. So you would not need I20 information in those cases.

            I read the instructions for I-485. It states that I need to include a copy of I-20 as an evidence of continuously maintaining a lawful status since arrival in the United States, but it doesn't specify whether I need to send the copies of all of my I-20s including the old ones or they only want the most recent I-20. That's where my confusion came from. Thank you very much!

                Oh, My bad. You're absolutely right. I freaked out a little bit, but it also states that only the applicants (applying under a family-based preference category or an employment-based preference category; special immigrant religious workers, Afghan or Iraqi nationals, and international broadcasters; and selectees under the Diversity Visa Lottery program) are required to submit I-20 as an evidence of continuously maintaining a lawful status since arrival. Since my application is marriage based (Immediate Relatives), I guess I should be fine! Thank you very much.

                  You would need to include the I94 from your latest entry as a proof that you entered with inspection. Anything else is not mandatory.
