    Hi,

    I am planning to sponsor my spouse for an adjustment of status. Her current visa is an F1. Before this time, she was on a J1 Visa for about a year and a half. The problem is that the I-94 records on the customs and border protection website are not updated. They do not seem to have her registered on the date she came here on her F1 Visa. Instead, they still have her listed on the date she came over to the US on her J1 Visa. My question is, is this going to be a problem when filing the I-485 AOS? Any advice on how to get this changed? I have read that we may need to go directly to a customs and border protection deferred inspection site and if this is the case, does anyone know what documents we may need?

    She came in on an F1 visa (instead of doing a Change of Status to F1 in the US)? Did she get a paper I-94? So she does not have an I-94 at all (paper or electronic) for her current status? She should call a CBP office for help; it's possible there was a typo in her name or passport number.

      Send CBP an email from this site: https://help.cbp.gov/app/ask stating that your spouse's latest online I-94 is incorrect. They usually respond in a day (or hours!) asking for you to email a scan of the biographic page, visa page and the entry stamp page of the passport of the traveler. After they receive it, and another day or so they will respond saying that they corrected the issue. The online system will then start showing you the accurate I-94 record.

      This happened to my Mom and I was able to get help from the CBP. They responded quickly and that too on a Sunday! That was impressive speed and efficiency.
